Active litigant
in a wide range of areas of the law, practicing in the Supreme
Court and Court of Appeal of British Columbia and the Supreme
Court of Canada. A few examples of which are: Acting for the
Federal Government in the R. vs. Sparrow, a leading modern
native rights case, Fales vs. Canada Trust, a leading case
in the duties of executives, Construction cases (one lasting
over 121 days), Criminal cases, Motor Vehicle Accident cases.
Argued the London Drugs case in the Supreme Court of Canada
which allowed the advertising of prescription drugs in British
Columbia, acted for the Federal Government against the Law
Society of British Columbia to allow lawyers to advertise
and various criminal matters.
While on the Court of Appeal he wrote a dissent in the Catholic
Children’s Aide case, the reasons of which formed the
basis for the amendment of the Law of Trusts in British Columbia.
Was active in the field of arbitration as counsel and as arbitrator,
including sitting on the major dispute on the cost over-run
in the construction of the No. 5 paper machine at Elk Falls,
property evaluation, domestic and various other arbitrations
often as chairman. An active litigant in estate matters.
CURRENT AREAS OF PRACTICE
Mr. Braidwood is now concentrating on opinions and arbitrations,
including but not limited to commercial real estate, estate,
construction, business partnerships and domestic.
